Is Sunday a mandatory rest day in Myanmar?

Sunday is Myanmar's default rest day under the Factories and S&E Acts, but employers may designate another day so long as employees get 24 continuous hours off.

What Myanmar law says

Sunday is the default weekly rest day in Myanmar but is not legally locked. The Factories Act 1951 and Shops & Establishments Act require one rest day per week of at least 24 continuous hours; both statutes use Sunday as the default but allow employers to designate a different day, including a rotating roster, so long as each individual employee receives one full rest day every calendar week.

Most Myanmar employers stick with Sunday because public-sector and bank holiday calendars are aligned to it, simplifying customer interaction and supplier coordination. Restaurants, hospitals, and continuous-process factories that cannot close on Sunday rotate the rest day across staff.

Edge cases

  • Friday rest day — common for businesses with Muslim-majority customer bases; legal if documented.
  • Rotational rest — restaurants and 7-day operations frequently rotate staff rest days; track in a roster.
  • Two-day weekends — Saturday + Sunday off is contractual generosity, not a legal requirement; employers can withdraw it with notice if not in the contract.
  • Public holiday on Sunday — employee is entitled to a compensatory holiday; do not let the public holiday "absorb" the rest day.
  • Continuous-process exemptions — sector notifications may permit deferred rest with comp-off scheduling; verify with the township labour office.

Records and inspections

The attendance register should clearly show the designated rest day for each employee and any worked-rest-day instances with the OT or comp-off entry. Retain for ≥ 7 years. The township labour office looks for employees missing rest entirely and for unpaid weekend OT during inspection.

Employer takeaway

Sunday is the default rest day in Myanmar but employers can lawfully designate a different day so long as every employee receives one continuous 24-hour break each week. Document the designated day in the employment agreement or shift roster. Pay weekend OT or grant comp off when an employee works the rest day. Retain records for 7 years.

Common mistakes

  • Assuming the law forbids any non-Sunday rest day — it doesn't, but the change must be documented.
  • Letting rotational rest slip so a worker goes 8 days without a break.
  • Confusing two-day weekends (a benefit) with one weekly rest day (a statutory floor).
  • Forgetting to compensate when a public holiday falls on the rest day.
